Heard Mr. Bhanage, learned counsel for the Applicant and Mr. Jayant Bhat, the legal heir of the Respondent who appears in person.

For the reasons set out in the Civil Application, a case is made out for recall of order dated 22nd November, 2018 subject however to payment of cost. The learned counsel for the Applicant volunteers to pay the cost of Rs. 20,000/- to the Respondent. 3.

Accordingly, the order dated 22nd November, 2018 is recalled subject to payment of cost of RS. 20,000/- to the Respondent No. 1 on or before 20th December, 2018. 4.

Civil Application is disposed of.
