Mr. Joshi states that vakalatnama will be filed within two weeks from today. This statement is accepted. 2.

As against the impugned order dated 7th September, 2017 the Petitioner has remedy of instituting the Appeal under Order 43 Rule 1(t) of Code of Civil Procedure. Accordingly, Mr. Joshi, learned counsel for the Petitioner seeks leave to withdraw this Petition with liberty to file an Appeal.

Leave is granted with liberty as prayed for.

Further it is noted that as against the impugned order dated 7th September, 2017 this Petition was filed on 20th December, 2017 and was pending till date.
