The above Interim Application is filed seeking condonation of delay of approximately 10 days in filing the above Appeal. The learned counsel appearing on behalf of the Applicant/Appellant submitted that actually there is no delay because the period for filing the appeal is 90 days as per the full Bench Judgment of this Court in the case of Shivram Vs. Sharmila 2017 (1) Mh.L.J. 281. He submitted that if 90 days are counted, then there is no delay because the impugned order was passed JULY 14, 2023 Husen
20 IA-1805-2023 .doc on 11.10.2022, a certified copy of the same was supplied on 12.10.2022, and the present appeal is lodged on 22.12.2022. In fact, we find that the Office/Department has also verified the same and made a noting on the board that the appeal is filed in time.

In these circumstances, nothing survives in the above Interim Application and the same is disposed of. 3.
The Registry is now directed to number the above Appeal subject to any other objections being removed by the Applicant/Appellant.
