P.C:- On 14th December, 2018, we passed the following order:- "1.
The petitioner' grievance is that despite a judgment of this Court dated 27.09.2018 in Writ Petition No.10999 of 2018, the Department has not deleted the petitioner's name from the denied entity list on account of which the petitioner is not allowed to make application for license for future export. Mr. Jetly, learned Counsel for the Department stated that judgment of this Court dated 27.09.2018 is challenged before the Supreme Court. The SLP is yet to be taken up for admission hearing.
More that 2 1/2 months have passed since this Court rendered the judgment in favour of the petitioner. In the meantime, for non implementation of directions, the petitioner is prevented from making applications for license for import. By way of last chance, we grant one week time to the Department. If within such time, no stay is obtained, we may ask the S.R.JOSHI
wp-14022-2018 Department to carry out the directions of this Court contained in order dated 27.09.2018.
Stand over to 21st December, 2018.
Parties to ask on a copy of this order duly authenticated by the Associate of this Court."
Mr. Jetly, learned Counsel for the Respondents, on instruction, states that Petitioner's name would be deleted from the denied entity list. Thus, making it possible for the Petitioner to make application for licence with the office of D.G. of Foreign Trade. In view of the statement made by Mr. Jetly on behalf of the Respondents, Mr. Shah, learned Counsel for the Petitioner seeks to withdraw this Petition. However, he seeks liberty to urge all contention before the Authorities.
Liberty as prayed for, granted.
