Mr. Kanetkar, the learned counsel appearing for Respondents would submit that the Regular Civil Appeal No.119 of 2018 is being taken up for final hearing by Trial Court. In that view of the matter it is not necessary to determine correctness of Order dated 15 October 2019 in the present Appeal and it is appropriate that District Judge decides Civil Appeal No.118 of 2018 without being influenced by any of the observations made in the Order dated 15 August 2019.
