WEDNESDAY, 16 th JANUARY 2019 P.C. :

FIR has been registered in pursuance of orders under Section 156(3) of the Code of Criminal Procedure obtained by present petitioner. Grievance is, since then there is no progress. Print out annexed as Exhibit `C' shows that 69th Court of Metropolitan Magistrate has adjourned the matter continuously and police have not submitted any report or charge-sheet. Petitioner is therefore praying for expediting the process. Learned A.P.P appearing for respondent-State is seeking time.

wp.5363.17.46.doc We find that interest of justice can be met with, by directing Investigating Officer to file suitable report for consideration of that Court within four weeks from today.

Accordingly, we direct the Investigating Officer at J. J. Marg Police Station, Mumbai to submit report to 69th Metropolitan Magistrate Court on 18th February 2019. Petitioner shall remain present on that date and assist the Court in further prosecution of the matter.

With these directions and keeping all contentions open, we dispose of present petition.
