Heard learned counsel for the applicant and learned APP for the State.

This is an application for bail by the applicantNatrajan Murugan Tevar @ Harijan in connection with C.R. No.1067 of 2021 dated 28/12/2021, registered with Mulund Police Station, under sections 326 and 504 of the Indian Penal Code, 1860.

The incident took place on 28/12/2021. It is alleged that there was a scuffle between the applicant and the complainant. The applicant abused the complainant. The 1/3
applicant hit the complainant with a beer bottle which was lying on the road. The complainant suffered injury to his left ear. The complainant was not admitted to the hospital. After giving medical treatment he was discharged. The applicant is in custody from 29/12/2022 for a period of more than 1 year and 1 month.

Learned APP pointed out as many as 19 criminal antecedents recorded against the applicant, out of which the applicant was acquitted in 15 criminal cases. However, this can not be the ground to refuse bail to the applicant. Some stringent conditions need to be imposed on the applicant so that the applicant does not indulge in similar activities.

Learned counsel for the applicant makes a statement that the applicant shall reside outside Mumbai till the trial is over. It is further stated that the applicant will reside at Uran. The statement is accepted.
ORDER
(a) Applicant- Natrajan Murugan Tevar @ Harijan in connection with C.R. No.1067 of 2021, registered with Mulund Police Station, shall be released on bail, on his furnishing P.R. Bond of 2/3
Rs.25,000/- with one or more local sureties in the like amount;
(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence;
(c) The applicant shall report to the Mulund police station once in every 15 days i.e. on first and third Sunday of every month between 11.00 a.m. and 1.00 p.m;
(d) While residing at Uran, the applicant shall report to the Uran police station once a week on every Saturday between 11.00 a.m. and 1.00 p.m;
(e) The applicant shall not enter Mumbai except for attending trial Court and reporting to the Investigating Officer.
(f) On being released on bail, the applicant shall furnish his contact number and residential address to the Investigating Officer and shall keep him updated, in case there is any change. 6.
The application is disposed of.
