This is an application for modification of the condition imposed by this Court vide order pronounced on 03/10/2023 in Bail Application No. 785 of 2023. 2.

Instead of the security of Rs.5 Crores, the applicant by the present application has prayed that he may be permitted to furnish the personal property of his married daughter Smt. Khushboo Gard as well as that of his old 1/2

Darshan Patil 934-ia-4411-23.doc family friend Shri Rahul Taneja as security which according to him, valuation is more than Rs. 5 Crores. The valuation report and affidavits are filed on record.

The application is opposed by learned counsel Shri Venegavkar appearing for respondent No.1.

However, for the reasons mentioned in the application and after perusing the affidavit and the valuation report, I am satisfied that the condition can be modified, since the personal liberty of the applicant is involved. 5.

The condition of depositing of Rs.5 Crores can be suitably modified and this application is allowed in terms of the prayer clause (a).

The interim application is disposed of.
