The Petitioner addressed a letter cum hand written writ petition dated 11/06/2015 thereby praying for directions to the concerned jail authorities to transfer him from Kolhapur Central Prison, Kolhapur, at Kalamba to Aurangabad Central Prison.
Mr. Sudhir N Kingre, working at the relevant time as the Superintendent of Kolhapur Central Prison, Kolhapur at Kalamba has filed an affidavit. It it averred in the said affidavit that the Petitioner's prayer was considered and rejected for the reasons that in the Aurangabad Central Prison lgc
(5) wp-1910.15.odt already there are more inmates than the capacity of the said jail. It is also stated that the inmates placed in the said jail are three times more than its prescribed capacity. One of the reason given for rejection of the prayer of the Petitioner was of acute paucity of water in the said jail. We are satisfied that the reasons assigned by the concerned jail authority are legally and factually sustainable. Hence no case is made out to entertain the Writ Petition. Hence the Writ Petition stands disposed of. In view of the disposal of the Writ Petition, nothing survives for further consideration in Criminal Application Nos.541 of 2018 and 507 of 2018, hence both the Criminal Application also stand disposed of.
