The report of the Additional Sessions Judge, Pune dated 15/1/2018 is received. It shows that the charge could not be framed for want of presence of the original accused No. 4. Execution of nonbailable warrant issued against the accused No. 4 is pending for a very long time. In these circumstances, the learned Sessions Judge would separate the trial of original accused No. 4 and proceed with the trial of the other accused especially, the present applicant, who is in custody since 26/9/2011. In fact, by now the trial ought to have Talwalkar 1/2

22.ba3012.17 been concluded. The case was scheduled before the Sessions Court on 12/2/2018 i.e. today.

The learned Sessions Court shall not be oblivious of the fact that the applicant is in custody for about 6 and half years without even framing of charge. The learned Sessions Judge shall frame charge at the earliest and preferably within one week from the date of receipt of this order and proceed with the trial forthwith and conclude the same preferably within 9 months from the date of framing of charge. With these observations, the application stands disposed of accordingly.
