The above Writ Petition has been filed for seeking directions that the Respondent No.2 Board to be directed to consider the applications submitted by the Security Guards listed at Exhibit A in accordance with law and grant them the registration.
A perusal of Exhibit A discloses that there are 99 persons who, according to the Petitioner, are its members and in respect of whom the applications have been made by the Petitioner-Union for registration with the Respondent No.2.
The learned counsel appearing on behalf of the Respondent No.2 Mrs. Lata Desai draws our attention to the communication dated 18/09/2017 of the Respondent No.2 addressed to the Petitioner-Union in which communication it is mentioned that by letter dated 06/09/2017 the applications of 27 persons have been received for registration by the Respondent No.2. It is further mentioned in the said letter that in the event the Petitioner desires registration then the application may be made on the website, portal name of which is mentioned in the last paragraph of the said letter. It therefore appears that though the persons appearing in Exhibit A are numbering 99, the applications received are in respect of only 27 guards. However, the learned counsel for the Petitioner seeks to dispute the said position.
The learned AGP informs us that now the modality of making the application registration online on e-mahapariksha portal is sought to be devised and the same would be notified within a period of one month from date. The same is in compliance of the directions as contained in the order of the Division Bench dated 08/02/2017. It is not necessary to keep the above Writ Petition pending. The Respondent No.2 may process the applications of such of the members of the Petitioner that have been received by it till date. In so far as the future applications are concerned, the Petitioner Union may make the said applications for registration on the site which would be notified by the
State Government within one month reference to which we have made in the earlier part of this order.
With the directions as aforesaid the above Writ Petition is disposed of.
