The learned counsel for the Respondent No.1 has tendered an Affidavit filed by one Ashwin Liladhar Shah i.e. the Respondent No.1. The factum of there being any negotiation or settlement between the parties is denied in the said Affidavit (See paragraph 7 of the said Affidavit). In the light of the said Affidavit, the learned counsel appearing on behalf of the Applicants Shri Vikram Sutaria, on instructions of the Applicants, seeks withdrawal of the above Criminal Application. The above Criminal Application is accordingly allowed to be withdrawn and dismissed as such. Needless to state that this Court has not gone into the aspect as to whether there was any negotiation or settlement between the parties and has also not considered the matter on merits.
