Heard this is an application under section 438 of the Criminal Procedure 1/3

Code.

The Applicants herein are apprehending their arrest in Crime No. I119/2017 registered at Niphad Police Station for the offences punishable under section 407, 467 and 468 r/w. 34 of the Indian Penal Code. 3.

The Applicant Meenakshi was the Deputy Sarpanch of Village Nevali, Tal. Niphad, Dist. Nashik during the period from 2011 to 2015 and that there was misappropriation in implementation of the Indira Awas Yojana. It is the case of the prosecution that the gramsevak had lodged the report in respect of mis-appropriation of total amount of Rs.6,20,000/-. Sarpanch has deposited the amount of Rs.6,20,000/- in this Court. The Applicant in ABA No. 735 of 2018 viz. Phulchand Waghchaure is a Block Development Officer. 4.

It is the submission of the respective counsel for the Applicants that in fact list of beneficiaries was available with the Panchayat Samitee and that they have received the money.

It appears that there is misappropriation of funds of the subsidiary amount received for implementation of Indira Awas Yojna. The Applicants were granted interim relief. They were co-operating with the Investigating Officer to the best of their capacities.

In view of this, the order granting interim relief deserves to be confirmed in the same terms and conditions. All the three applications for anticipatory bail are allowed.
