The petitioner is an accused in FIR No.349 of 2018 registered with Juhu Police Station at Mumbai for the offences punishable under Sections 354, 354D, 509, 506(2) of the Indian Penal Code, 1860 and Section 66E of the Information Technology Act. Learned counsel for the petitioner, having taken instructions from his client, makes a statement that the subject CR is investigated and "B" summary report is filed by Juhu Police Station. He further submits that this "B" summary report is accepted by learned Metropolitan Magistrate, 10th Court at Andheri, Mumbai. In support of his statement, he has placed on record, a copy of the order dated 15th June, 2019 passed by learned Metropolitan Magistrate, 10th Court at Andheri in CC No.145/Misc/2019. In the light of the above, learned counsel for the petitioner, seeks leave to withdraw the petition as the grievance raised in the petition, no more survives. We, accordingly, grant leave as prayed for, The petition is disposed as withdrawn.
