Being aggrieved by the order passed by the NDPS Special Judge, Court in Miscellaneous Application No.1085 of 2017, this Application is filed by the Applicant.

It appears that Application was filed by the Applicant for modification of condition as laid down in Bail order 25 January 2017 passed in Bail application No.54 of 2017 for condition imposed upon the Applicant-Accused of reporting to attend office of NCB on every

2 4 APPA 1733 - 17 in APEAL 601 - 2016 .doc first and third Monday of each month between 10.00 a.m. to 1.00 p.m. Said application was rejected by the learned Judge on the ground that the Appeal filed by the Appellant is pending before the High Court.

During the course of hearing of the Application, learned counsel appearing for Respondents on instructions submits that if the Applicant reports to NCB office, Mumbai once in two months, NCB has no objection for modification of the condition laid down in the order dated 25 January 2017. In that view of the matter, the Applicant instead of reporting to NCB Mumbai, on first and third Monday of each month between 10.00 a.m. to 1.00 p.m. can report to NCB Mumbai, once in two months. Accordingly, the condition to report NCB office Mumbai, on first and third Monday of each month between 10.00 a.m. to 1.00 p.m. by the Applicant stands relaxed and substituted by following - The Applicant to report to NCB office, Mumbai once in two months, i.e. on any Monday, in between 10.00 a.m. to 1.00 p.m.
