The Petitioner is aggrieved by the adjournment granted to the consideration of the application below Exhibit-35 by the learned Judge of the Family Court. By the said application, the Petitioner had prayed for grant of access to two children for the period 16/12/2023 to 01/01/2024. The next date of the proceeding was assigned as 28/02/2024 and hence this writ petition.

We find that the application below Exhibit-35 is pending before the Family Court. Considering the nature of relief sought in the said application, it would be necessary to consider the prayer made therein prior to 16/12/2023. It is therefore directed that the Family Court shall consider and decide the 1/2 904-WP-15325-23.doc Rameshwar Dilwale

application below Exhibit-35 by hearing the learned counsel on 11/12/2023. The learned counsel for the parties shall appear before the Family Court on the said date in the said proceedings to enable the consideration of the said application. In case the learned Judge assigned with the present matter is not available on the said date, the learned Principal Judge, Family Court , Mumbai shall assign the same to any other Court. It is clarified that all points on merits are kept open. It is expected that the application below Exhibit-35 would be decided on its own merits prior to 16/12/2023.
