Learned AGP raises preliminary objection that there is an alternate remedy of appeal against the impugned order. Learned counsel for the petitioners does not dispute that there is an alternate remedy.

Learned counsel for the petitioners seeks leave to withdraw the petition with liberty to file an appropriate appeal under the provision of Maharashtra Land Revenue Code, 1906. He submits that the ad interim protection granted by this court on 18th December 2023 be continued for sometime to enable the petitioner to file an Page no. 1 of 2

71-wp-15627-2023.doc appropriate appeal as well as an application for interim protection before the Appellate Authority. Leave granted with liberty as prayed. Petition is disposed as withdrawn with liberty as prayed. 3.

Interim protection granted by this court vide order dated 18th December 2023 to continue for a period of six weeks. 4.

If appropriate appeal is not filed within a period of three weeks from today, alongwith an application for interim protection before the Appellate Authority, interim protection granted today shall stand vacated.
