Learned Counsel for the Applicant submitted that this Court (Coram : N.R.Borkar, J.) by Order dated 12.01.2023 had passed following order:

"Considering the fact that the applicants are in jail for more than 2 years, the trial court shall endevour to conclude the trial as early as possible. In case the trial is not concluded within a period of six months, then the applicants are at liberty to file bail application before the trial Court. The application is disposed of."

Learned APP on instructions submitted that trial has been started and four witnesses have been examined, yet eight witnesses has to be examined. Hence, requested to pass appropriate order. 1/2

Considering the submission of learned APP, learned Counsel for the Applicant on instructions seeks leave to withdraw this Application. 5.

Considering the request of learned Counsel for the Applicant, Application is allowed to be withdrawn.

Learned Counsel for the Applicant submits that direction be given to the Trial Court to expedite the trial within six months. 8.

Considering the submission of learned Counsel for the Applicant, learned Trial Court is required to dispose off the trial as early as possible preferably within one year.
