Respondent no.2 is present with his counsel. He states that he is not interested in prosecuting the matter. Accordingly affidavit is also filed before this court. Counsel for petitioner informs that respondent no.2 was tenant and dispute arose out of that relationship. The entire controversy is now settled and other matters have already been withdrawn. In this situation, accepting the joint request, we make the rule absolute in terms of prayer clause (b).
