The order under challenge in this petition is the refusal to grant permission to the petitioner to make oral submissions, since the petitioner has already submitted his written notes of arguments.

The other side is very much present before the Court. Without going into the merits of the matter, the purpose could be served if the petitioner is given time-frame to make his submissions before the Appellate Court, to which the other side appears to have no objection.

In view of the above, the petition stands disposed of. 5.

The order impugned herein is set aside. The petitioner shall advance his oral submissions before the Appellate Court on 13th of this month without fail.

Needless to mention that the other side shall have an opportunity to respond/reply thereto. If the arguments are not concluded on the given date, the same to continue on the next working day.
