This is application for condonation of delay of 172 days in challenging the judgment and award passed by the learned Commissioner for the Employees Compensation and Judge Labour Court, Ratnagiri in ECA No.9/C-1/2013.

Heard learned counsel for the appellant and learned counsel for the non-applicant/original applicant in ECA No.9/C-1/2013. 2.

After hearing both the learned counsel and after having gone through the statement made in the application for condonation of delay, this Court is of the opinion that delay needs to be condoned. Hence, following order:

ORDER

i) Application for condonation of delay is allowed;

iii) The delay is condoned subject to payment of cost of Rs.10,000/- to be paid within a period of 3 weeks from today. Registry shall register the appeal subject to payment of cost. The original claimant shall withdraw the amount so deposited without moving any application.
