Heard the learned Counsel for Applicant. Though the Respondent is duly served, no one appears for the Respondent when the matter is called out today.

This Civil Application is filed for restoration of Family Court Appeal No.178 of 2014 which stood dismissed for nonprosecution vide order dated 27/02/2017. The learned Counsel for the Applicant submits that the Applicant undertakes to file private paper-book within three weeks from today. The statement is URS

Considering the submissions made by the learned Counsel for the Applicant and the averments made in the Civil Application, we are satisfied that the Applicant has made out case for the following order.

ORDER

(i) Family Court Appeal No.178 of 2014 is restored to file for hearing on its own merits.

(ii) The Applicant to file private paper-book as per the earlier order dated 27/02/2017 with copy to the other side, on or before 14/03/2018.
