After arguing for some time, Learned Counsel for the applicant upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. Learned Counsel for the applicant further submits that the applicant would surrender before the Magistrate on or before 4/7/2018. In view of this, the applicant stands protected till 5 p.m. of 4/7/2018. The learned Magistrate shall consider the application on its own merits without being influenced by the withdrawal of the present application under section 438 of the Code of Criminal Procedure, 1973.
