This is an application for relaxation of condition of reporting stipulated in order dated 12th July, 2017, passed by this Court in Criminal Application No.347 of 2017. Applicant was directed to report to Sojitra Police Station, Piplav village, District-Anand, Gujarat, once in a fortnight on Saturday between 11:00 a.m. to 01:00 p.m. Learned
rpa 2/3 501-appp-1525-18.doc counsel for the applicant submitted that in pursuant to that the applicant has been attending the said police station and certificate in that regard has been issued by the Police SubInspector of Sojitra Police Station, Piplav village, District - Anand, Gujarat dated 24th November, 2018, translation along with the original which has been annexed to this application. It is submitted that the applicant has been attending the trial Court regularly on the date of hearing of the case. Learned APP, however, submitted that the proceeding are pending in the Court at Mumbai and the applicant is resident of Gujarat and, hence, the condition of reporting should not be relaxed. By order dated 12th July, 2017, applicant was directed to attend the police station as stated hereinabove.
Apparently, the applicant has complied the said condition. However, considering the fact that the applicant is a resident of Gujarat, the condition cannot be relaxed completely.
