By an Order dated 17.01.2018, the Applicant was granted interim relief.

It is the case of the first informant Mr. Soyeb A. Shaikh that, the Applicant was working with his firm namely Pranik Enterprises as an Accountant and during the period from January 2015 to January 2017 defalcated an amount of Rs.1,90,000/-.

The record indicates that, the father of the Applicant namely Mr. Riyaz D. Shaikh has paid an amount of Rs.2 Lakhs on 09.02.2017 and 10.02.2017 to the informant by cheques and the said cheques have been realized. The Bassein Catholic Co-operative Bank has issued a certificate dated 04.01.2018 to that effect.

In view thereof, for further investigation of the present crime, the custodial interrogation of the Applicant is not necessary. Interim relief granted by Order dated 17.01.2018 is hereby confirmed. 5.
