Both the Counsel submits minutes of order duly signed by them. Same is taken on record and marked 'X' for identification. Same is accepted. Minutes of order reads thus : "a)Judgement and order passed by the 8th Jt. Civil Judge Junior Division, Kolhapur in Regular Darkhast No. 147 of 2017 below Exh. 26 dated 28-11-2018 is quashed and set aside. b) Miscellaneous Civil Application No. 50 of 2018 filed by the Petitioner for condoantion of delay is allowed. c) An application filed by the Petitioner for setting aside of ex-parte Judgment and Decree in Regular Civil Suit No. 1000 of 2016 dated 6-06-2017 shall be decided by 8th Jt. Civil Judge Junior Division, Kolhapur on or before 15-02-2019.

d) Till decision of an application filed by the Petitioner for setting aside of ex-parte Judgment and Decree in Regular Civil Suit No. 1000 of 2016 dated 6-06-2017; i.e. till 15-02-2019, execution implementation and operation of the said Judgment and Decree S.C.Magar

905-wp-14484-2018.doc passed in Regular Civil Suit No. 1000 of 2016 dated 6-06-2017 shall remain stayed, e) Parties to appear before the 8th Jt. Civil Judge Junior Division, Kolhapur on 16-01-2019."
