The learned Counsel for the applicant upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice.

The learned Counsel submits that the applicant would surrender before the Court of concerned Magistrate on or before 16/1/2018 and file an application under section 437 of the Code of Criminal Procedure, 1973. The learned Magistrate shall consider the application on its own merits. The learned Magistrate shall not be Talwalkar 1/2

In view of the above the applicant stands protected till 5 p.m. of 16/1/2018. Upon failure to appear before the Magistrate on or before 16/1/2018, the investigating agency would be at liberty to arrest the applicant.
