P.C.:- This is an application for bringing legal heirs of sole Petitioner on record. There is a delay of 1 year and 9 months in filing the present application.

Mr. Apte, learned counsel for the Respondents opposed the application and submitted that, proper explanation for condonation of delay is not offered by the Applicants.

Perusal of application would indicate that, sufficient cause is made out for permitting the Applicants to come on record. However, taking into consideration the delay caused in filing the present application, this 1/2

spm 2 12-civil-caw46.19.doc Court thinks it appropriate to impose a cost of Rs.5,000/- (Rs.Five Thousand Only) for condonation of said delay. The Applicants are directed to pay a cost of Rs.5,000/- to Kirtikar Law Library, High Court Bombay, within a period of two weeks from the date of uploading of the present Order on Official Website of the High Court.

Subject to payment of cost, delay is condoned and Application is allowed in terms of prayer Clauses (a) and (b). 4.

Necessary amendment be carried out in the record of Court and simultaneously in the copies served upon the learned Advocate for the Respondents within the same stipulated period. (A.S. GADKARI, J.) 2/2
