By an Order dated 9.1.2018 the applicant was granted interim relief.

Heard Shri. Gupte, the learned Senior counsel for the applicant and the learned APP. Perused the record of investigation.

The record of investigation indicates that in furtherance of the Order dated 9.1.2018 the applicant attended the Investigating Officer and extended his coPage-1/2
17-aba-2267-17 operation in the process of investigation. The hand set of mobile phone of the applicant has been seized by the police and the same was sent for analysis of the messages which were allegedly sent by the applicant to the first informant. The learned APP. on instructions submitted that, nothing objectionable is found after analyzing the said messages. As noted in the earlier Order dated 9.1.2018 the applicant was having extra marital relations with the first informant who was aged about 42 years on the date of lodgment of the crime. In view of the fact that, the applicant has co-operated in the process of investigation and nothing further is to be recovered at his instance, the applicant can be granted pre-arrest bail.

In view of the above, the interim relief granted by Order dated 9.1.2018 is hereby confirmed. However, the condition to attend the Investigating Officer is waived. 5.
