This is an application for grant of temporary bail. The application is made on the ground that there is First Holy Communion Ceremony of the Appellant's son, namely Arron Rajan on 28th January, 2018.
The Appellant had initially moved for parole, however, Aswale 1/3
since the ground on which the relief is sought is not covered under the Parole Rule, the application was rejected. The learned counsel for the Appellant has placed on record document showing that when on earlier occasion the Appellant was released on parole, he has himself surrendered on the scheduled date. The copies of the said document are taken on record and marked "X" for identification.
The Appellant has also annexed the invitation card along with an application.
Taking into consideration these aspects of the matter, we are inclined to allow the application.
The Appellant is directed to be released on temporary bail for a period of one week commencing from 24th January, 2018 till 31st January, 2018 on furnishing bail bond in the sum of Rs.10,000/- with one or more sureties in the like amount. The Appellant shall surrender to the prison on 1st February, 2018 prior to 11.00 a.m.
