DATE : JANUARY 8, 2019 P.C.:- Having heard learned counsel for the applicant, it is noticed that this Court by a reasoned order dated November 25, 2016 passed in Bail Application No.1824 of 2016 had rejected the application for grant of bail. But for the fact that there is no progress in the trial, there are virtually no change in circumstances. In view of above, this Court is not inclined to reappreciate the entire matter again.

At this stage, learned counsel for the applicant makes a grievance that though in January, 2015 muddemal property are sent for analysis, the chemical analyser's report is yet to be received.

Perused the letter sent by the investigating officer to the Director, Forensic Science Laboratory, Kalina, Mumbai on January 25, 2016. The office of Forensic Science Laboratory to submit the C.A. report pursuant to the reference made on January 25, 2016 in Crime No.19/2016 registered with M.H.B. Colony police station, Borivali (East), Mumbai within a period of three months from today. It would be the responsibility of the investigating officer to see the compliance of the same. 4.

After the receipt of the said report, the applicant will be at liberty to apply afresh for grant of bail before this Court. 5.
