DATE : December 20, 2018 Heard the learned counsel for some time.

Considering the fact that by communication dated 13/11/2018 the appellant's membership has been suspended for a period of six months, the case requires expeditious adjudication at least as regards the prayer for interim relief. The trial Court was therefore not justified in observing that there was no urgency in the matter.

Be that as it may, the following order would serve the ends of justice :

The defendant shall file reply to the notice of motion till 30/12/2018 with an advance copy to the

The trial Court shall decide the said notice of motion expeditiously on its own merits after hearing both the sides preferably by 25/01/2019. It is made clear that all contentions and grounds raised in the present appeal are kept open. Similarly the respondent is free to raise all defences.

The Appeal from Order and the Civil Application are disposed of in aforesaid terms.
