The State of Maharashtra .....Respondent Mr. Avinash B. Patil for the applicants Ms. Rutuja Ambekar APP for the State CORAM : NITIN W. SAMBRE, J.
DATE :
JANUARY 8, 2019.
P.C.
In crime no. 224 of 2018 registered with Palus Police Station, Dist. Sangli for offence punishable under sections 307, 323, 143, 147, 148, 149, 504 and 506 of the Indian Penal Code. Applicants came to be arrested on 29/10/2018.
The learned counsel for the applicants submits that the only overt act attributed to the applicants in the F.I.R. is somewhat
2 5.3249.18 ba.doc exaggerated. According to him, investigation is almost over and as such, applicants are entitled to be released on bail. The learned APP opposed the claim for release on the ground that there are eye witnesses to the incident and specific role is attributed to the accused.
Perused injury certificate of victim Sachin who has suffered simple injuries. Applicant no. 2 Tanaji Mane is attributed role of assault by fist blows. Applicants are behind the bars for almost three months. That being so, in my opinion, application needs to be allowed. Hence, following order:
O R D E R
(I) Application is allowed.
(II) Applicants be released on bail in crime no. 224 of 2018 registered with Palus Police Station, Dist. Sangli on furnishing P.R. bond in the sum of Rs. 15,000/- each with one surety in the like amount.
