This is an application under Section 439 of the Cr.P.C. for bail in CR No. I-174-2018 dated 1.11.2018 registered with Chandwad Police Station, Nashik under Sections 498(A), 304-B and 306 read with 34 of the Indian Penal Code.

The first information report is lodged by Trimbak B. Vakate. It is the prosecution case that, the marriage of the daughter of the first informant namely Shakuntala was solemnized with Kedu K. Gangurde on 12.4.2012. That, the family of Kedu Gangurde is a joint Hindu family along with the present uncle of Kedu Gangurde. That the applicant and other in laws used to instigate Kedu Gangurde to demand dowry from Mrs. Shakuntala. It is alleged that due to the constant harassment and torture meted out by all the family members Mrs. Shakuntala committed suicide by hanging on 30.10.2018 prior to 3.15p.m. at her matrimonial house.
During the course of investigation the applicant came to be arrested on 1.11.2018.The applicant is aged about 70 years. The record indicates that the investigation of the present crime is at the verge of completion. It is to be noted here that, all the family members of Kedu Gangurde have been impleaded in the present crime. The observation made by the Supreme Court in the case of Arnesh Kumar vs. State of Bihar and anr. reported in (2014) 8 SCC Page-2/3
272 are squarely applicable to the present case. 4.
In view of the above, the applicant can be released on bail. Hence,the following order.
a) The applicant be released on bail in Cr No. I-174/2018 dated 1.11.2018 registered with Chandwad Police Station, Nashik on his furnishing PR bond of Rs.20,000/- with one or two solvent local sureties in the like amount.
b) The applicant shall attend the Investigating Officer one very first Monday of the month till the conclusion of trial. c) The applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
