DATED : 19th JANUARY 2024 P.C:- On 26/9/2022, the Bail Application was permitted to be withdrawn, since I had expressed my disinclination to entertain the same on perusal of the material in the charge-sheet. The present application is filed for the second time, seeking a similar relief.

As directed by the earlier order, though the charge is framed, there is no progress in the trial and this is the ground which is pressed by the learned counsel while securing the release of applicant on bail.

2/2 BA 3999-23.doc I am not inclined to consider the request even for the second time, in the wake of the involvement of the applicant as indicated in the charge-sheet.

Learned counsel for the applicant has also submitted the ground of ill-health of the applicant, but since this is not an application on medical grounds, but on merits, the applicant is at liberty to move the Sessions Court for being release on bail on medical grounds on furnishing necessary proof thereof. The present Application is dismissed.
