The order impugned is capable of being challenged by way of an appeal under Section 91 of the Trade Marks Act, 1999. Therefore, the petitioner is permitted to withdraw the writ petition with liberty to file an appeal.

The writ petition is, therefore, dismissed as withdrawn with liberty to file an appeal.
