Heard Ms Wagle, learned Counsel for the petitioner and Mr. Mali, learned AGP for the respondents-State.

By this Petition under Article 227 of the Constitution of India, petitioner has sought limited direction against the respondent No.2 to decide the stay application. Grievance of the petitioner is that against the order dated 26.06.2018 passed by the Deputy Registrar, Co-operative Societies, G/South Ward, Mumbai (for short 'Deputy Registrar') appointing Enquiry Officer under Section 83 of the Maharashtra Cooperative Societies Act, 1960, petitioner has instituted Revision Application before the Divisional Joint Registrar, Co-operative Societies. During the pendency of that Revision Application, application for stay was taken out and the Divisional Joint Registrar is not deciding the stay application.

Mr. Mali, on instructions, states that hearing of the Revision 1/2

WP14194_18.doc Application is fixed before the Divisional Joint Registrar on 15.01.2019 and within two weeks from today, Revision Application will be finally disposed of. Statement of Mr. Mali is accepted. 5.

In view thereof, Petition is disposed of. It is made clear that I have not examined merits of the order dated 26.06.2018 passed by the Deputy Registrar.
