As the Petitioner intends to apply for "Gati Shakti Multi-Modal Cargo Terminal(GCT)" scheme of the Respondent-Railways, learned Counsel for the Petitioner on instructions, seeks leave to withdraw the Petition, with liberty to file appropriate proceedings, seeking the very same 1/3

reliefs, as sought for in the present Petition, if the occasion so arises. 2.

Learned Counsel for the Petitioner on instructions, states that the Petitioner will be depositing the entire money with the RespondentRailways. 3.

Since the petitioner is withdrawing this petition and will be depositing the entire monies, we direct the Respondent-Railways to consider the Petitioner's Application for "Gati Shakti Multi-Modal Cargo Terminal(GCT)" scheme, on its own merits.

Petition is accordingly disposed of as withdrawn, subject to above.

Needless to state, that all rights and contentions of the Petitioner are kept open, including filing of a Petition seeking similar reliefs as sought for by the Petitioner in this Petition, if the occasion so arises. 6.

The Petition is disposed of on the aforesaid terms. 7.

It is made clear that we have not gone into the merits of the 2/3

petition and as such all contention of the parties are kept open. 8.

In view of the disposal of the Petition, the interim application does not survive and the same is also disposed of. 9.
