Mr. Jamdar, learned counsel for the Petitioner having taken instructions from his client makes a statement that in terms of clause 42 of the terms and conditions of the subject tender, the Petitioner will make a representation to the Commissioner of Nashik Municipal Corporation, Nashik to resolve the controversy between the parties within the period of two weeks from today. He accordingly seeks leave to withdraw the writ petition with liberty to make such representation. Leave with liberty as prayed for is granted. Petition is therefore disposed of.

In the event Petitioner makes such representation within the stipulated time, the Commissioner, Nashik Municipal patilsr 1 / 2

Corporation shall decide the same as expeditiously as possible and preferably within the period of four weeks from the date of receipt of such representation.

Needless to mention that the said representation shall be decided on its own merits and in accordance with law and the present order shall not be construed as an expression of any opinion on the merits of the case. The commissioner shall afford an opportunity of hearing to the Petitioner and dispose of the said representation by passing speaking order.
