P.C.:- By a well reasoned Order dated 17th December, 2018, the Applicant was granted interim relief and was directed to attend the Investigating Officer on the stipulated dates, to join the process of investigation.
Heard the learned counsel for the Applicant and the learned APP. Perused the record.
The Applicant is the husband of the first informant and father of prosecturix.
As noted in the Order dated 17th December, 2018, there are disputes between the informant and the Applicant which fact is 1/2
ssm 2 20-aba2571.18.doc apparent from the proceedings initiated by the informant. It prima facie appears that, the lodgment of this crime is the outcome of the same.
In view of the above, the Applicant is entitled to be protected by pre-arrest bail. Interim relief granted by order dated 17th December, 2018 is hereby confirmed. However, the condition to attend the Investigating Officer of the concerned Police Station is waived.
