At the outset, learned APP on instructions submitted that, in pursuance of leave granted by this Court on 30th March 2023, police have submitted charge-sheet in the Court of learned Metropolitan Magistrate, 44th Court, Andheri, Mumbai on 29th March 2023 and same has been numbered as R.C.C. No. 945/PW/2023.

In view thereof, the Petitioner is having substantive alternate remedy either to file an Application for discharge and/or to contest the said case as contemplated under the provisions of Cr.P.C. before the trial Court. 1/2

Petition is accordingly disposed off by reserving the said liberty in favour of Petitioner before the trial Court as contemplated under the provisions of Cr.P.C.
