It appears that the loan transaction is at the root of complaint. We, therefore, find that State machinery has been misused and public money has been lost.

Considering the financial condition of the parties, we, direct them, to pay to the Police Welfare Fund or State of Maharashtra, costs of Rs.5,000/- each, within two weeks. On payment of such costs, relief in terms of prayer clause (a) shall become absolute. REVATI MOHITE DERE, J.
