It is not in dispute that after pronouncement of the judgment by the Appellate Court, the original respondent to the second appeal, who was the original plaintiff expired. The civil application is filed for condonation of delay and for bringing the legal heirs of the original respondent on record.

For the reasons recorded in the Civil Application No.1121 of 2019, the civil application is made absolute in terms of prayer clauses (a) to (d). The amendment to be carried out forthwith. Reverification is dispensed with. The amended copy of the second appeal shall also be served upon the respondents including the newly 1/2

Place the second appeal on board for admission on 1st October, 2019.
