Heard learned counsel for the Applicant.

This is an application by the Appellant / employer in a dispute arising out of the Employees' Compensation Act, 1923. The application is filed for restoration of the above appeal, which is dismissed/rejected under conditional order dated 13 December 2021. 3.

Considering the fact that the conditional order was passed during Corona Pandemic period and the appeal was and is still at pre-admission stage and further considering that notices were never issued to Respondents in the appeal, the present application is allowed in terms of prayer clause (a). The appeal is restored to file, subject to condition that the Appellant will remove all the office objections within a period of 6 weeks from today, failing which the appeal shall stand dismissed without further reference to the Court.
