This application is preferred by the applicant/accused for bail.

The applicant/accused is convicted for the offences punishable under sections 279 and 338 of the Indian Penal Code and is sentenced to suffer S.I. for three months for each offence and also convicted for the offence punishable under sections 184 and 119/177 of the Motor Vehicles Act and sentenced to pay fine of Rs. 500/- and Rs. 100/- respectively, in default to suffer S.I. for one day by the judgment and order dated 17th February, 2017 Trupti Page 1 of 3

passed by the learned Judicial Magistrate First Class, (A.C.), Pune. The said judgment was challenged by filing Criminal Appeal No. 121 of 2017. The appeal was dismissed by the judgment and order dated 12th December, 2018 passed by the learned Additional Sessions Judge, Pune.

The learned counsel for the applicant/accused submits that the applicant/accused was taken in custody on the same date. He was on bail throughout the trial and also during the appeal period. He further submits that the applicant/accused is having a good case on merits. Hence, he prays that bail be granted to the applicant/accused.

The learned APP submits to the orders of the Court. 6.

Heard. Considering the submissions of the learned Counsel, the application is allowed on the following terms: a) The applicant/accused shall be released on bail upon furnishing P.R. Bond in the sum of Rs.10,000/- (Rupees Ten Thousand only) with one or two sureties in the like amount; Trupti Page 2 of 3

b) Applicant/accused shall make himself available at the time of hearing of the Revision Application.
