The Applicant is on temporary bail. Mr. Mohite, the learned Counsel for Applicant on instruction submits that the Applicant shall surrender by 28th January 2019. Since the statement is made on instruction same is accepted as an undertaking. 2.

During the course of hearing of the bail application, Mr. Mohite, the learned Counsel for Applicant on instruction has tendered three Demand Drafts for an amount of Rs. 10,00,000/-, Rs.3,50,000/- and

2/3 Yadav 901.ba.3322.18 Rs.4,50,000/- i.e. total amount of Rs.18,00,000/- drawn on ICICI Bank, TJSB Sahakari Bank Ltd., and Axis Bank respectively. 3.

The said Demand Drafts are permitted to be tendered with the Registry of the High Court, Appellate Side, Bombay. 4.

The said amount be kept with Registry as the amount in the crime in question.

Since at this stage the Court is not inclined, motion is made for withdrawal of the present Application. As such, Criminal Bail Application stands dismissed, as withdrawn.

Liberty to the Applicant to approach afresh in case if the coaccused Sagar Nade is arrested or surrendered in the crime in question. 7.

Investigating Officer in response to the query of this Court assures that action under Section 82 of the Code of Criminal Procedure will be initiated against the said untraced accused immediately.
