The applicant - accused and the respondent - complainant are present in the Court along with their respective Counsel. 2.

The parties have settled their dispute amicably. The Consent Terms are tendered on record. The Consent Terms are signed by both the applicant and respondent as well as learned Counsel for the respective parties.

Parties agree as regards recitals of the joint consent terms. The Consent Terms are taken on record and marked "X" for identification.

In view of the amicable settlement of the dispute, the judgment and order dated 30.05.2023 passed by the Additional Sessions Judge, Thane in Criminal Appeal No. 171 of 2018 confirming the judgment and order dated 31.08.2018 passed by the JMFC, 6th Court, Thane in Summary Criminal Case No. 3363 of 2016 convicting and sentencing the applicant for the offence punishable under Section 138 of the Negotiable Instrument Act is quashed and set aside.

The applicant - accused is acquitted of the offence punishable under Section 138 of the Negotiable Instrument Act. His bail bonds stands cancelled.

The Revision Application stands disposed of in the aforesaid terms.
