The applicant prays for relaxation of conditions (c) and (d) imposed by this Court while granting him bail vide an order dated 7th December, 2021 passed in Criminal Bail Application No.1025 of 2021. The conditions are stated below;

"(c)The Applicant shall not step in Ambernath Taluka till conclusion of the trial.

(d)The Applicant shall mark his presence before the Crime Branch, Thane (Unit 1) on every Friday between 10.00 A.M to 2.00 P.M.".

Learned Counsel for the applicant submits that the applicant is not the main accused in the alleged crime. The Counsel has also invited my attention to an appointment letter of the applicant from one CG Marketing Pvt. Ltd where he has been appointed as "Customer Service Associate". It is submitted that the trial has already commenced and seven witnesses have already been examined.

The learned A.P.P objects to relax conditions. 4.

Considering the fact of commencement of trial, no purpose would be served in directing the applicant to continue to attend the Crime Branch, Thane (Unit 1) on every Friday between 10.00 A.M to 2.00 P.M as stated in clause (d). The said condition stands relaxed. However, the applicant shall attend the trial Court on each date. Since condition (d) has been relaxed, there should be no hitch in relaxing condition (c) by which the applicant was restrained from entering in Ambernath Taluka till conclusion of the trial. The applicant shall not indulge in any illegal activities.

The applicant shall furnish his mobile number and permanent residential address to the concerned Police Station forthwith. 6.

As such, the application is allowed and disposed of in the aforesaid terms.
