1] The grievance raised by the petitioner stands redressed in view of the contentions raised in the affidavit in reply presented on behalf of Respondent Nos.2 and 3 by one Shri Dinesh Vitthalrao Khatte, Sub-Divisional Engineer, Mhaisal Lift Irrigation Management Sub-Division No.2, Taluka Miraj, Sangli. In paragraph (1) (h) it is recorded thus :

"(h) That in reply to the point '12' the answering respondent respectfully submits that, on the request of the petitioners to change the alignment of Canal (Distributory No.2) in Gat No.284, the proposal is initiated to get approval of the same the work will be carried out."

37.w56.19.odt 2] It is also recorded in the affidavit in reply that the property belonging to the petitioner would be acquired in observance of the procedure prescribed in that behalf. In view of the statement as recorded above, the grievance raised by the petitioner in the petition, stands redressed and nothing further survives for determination in the writ petition.
