On 3rd April 2024, I heard submissions of Mr. Satyavrat Joshi, learned Counsel for the Applicant, Mr. Topiwala, learned Counsel for Respondent No. 2 and, the learned APP.

On that day, as I was not inclined to allow the Application, Mr. Joshi sought time to take instructions.

After taking instructions, Mr. Joshi states that he has instructions to withdraw the Bail Application. However, he states that the Applicant is incarcerated since 11th March 2024. He states that liberty be granted to file a fresh Bail Application after a period of six months, in case there is no progress in the trial. 1/2

Accordingly, the Bail Application is allowed to be withdrawn and dismissed as such. However, the Applicant is granted liberty to file a fresh Bail Application after a period of six months, in case there is no substantial progress in the trial.
